**Terms and Conditions**

 

By placing an order with Livvy's Kitchen Cupcakes, you are agreeing to the following Terms and Conditions. 

 

Please take a moment to thoroughly review these terms before making a booking.

Please note emails are answered during business hours which are Monday to Friday, 8am to 6pm, according to availability. When a collection is taking place at the weekend, emails will be answered prior to collection.

Responses will usually be sent within 24 hours of receipt of your enquiry.

 

A non-refundable payment of 50% is required to secure the date and facilitate the purchase of ingredients and supplies. The remaining balance must be settled 14 days before delivery or collection. For orders placed less than two weeks in advance of the delivery or collection date, full payment is required at the time of ordering.

 

We accept payments via bank transfer.

 

**Quotes, Booking Fees, and Ordering**

 

Quotes provided are valid for three weeks from the date issued. A cake order is not confirmed until the 50% non-refundable booking fee has been received.

 

Please note that booking fees are non-refundable and non-transferable. By submitting payment, you enter into a binding contract with Livvy’s Kitchen Cupcakes and confirm your full and irrevocable acceptance of the Terms and Conditions.

 

**Your Order**

 

Once collected or delivered, the cakes become the sole responsibility of the purchaser. No refunds will be issued for any damage incurred after the cake has been handed over

.

Cake storage

Cakes are baked and decorated as close to your event date as possible and you will be advised of an approximate shelf life. They should be stored in a cool room temperature (not in the fridge, unless advised otherwise) hygienic environment, and any cake remaining after cutting should be covered to help prevent it from drying out too quickly. If a cake is being displayed in a warmer environment it should be stored in a cooler place for as close to the serving time as possible. Refrigerated cakes should usually be taken out between 30 minutes and two hours prior to being served, depending on the temperature in the room. It is not recommended to place cakes under direct sunlight, either outdoors or next to a window indoors, as this could melt some of the decoration. 

All cakes are photographed before collection, and the original files are stored as proof of quality assurance.

 

Livvy’s Kitchen Cupcakes reserves the right to photograph your cakes for promotional purposes on social media or our website. 

 

We warrant that upon collection, the cakes will conform to the description provided in the order, be of satisfactory quality, and comply with all relevant food safety, statutory, and regulatory requirements in the United Kingdom. Livvy’s Kitchen Cupcakes shall not be liable for customer disappointment regarding the design or interpretation of the cake, provided it aligns with the pre-agreed specifications detailed in the order confirmation. The customer assumes full responsibility for ensuring that all details within the order confirmation or sketch are accurate and meet their requirements.

 

This warranty does not extend to defects arising from wilful damage, accidents, negligence by the customer or a third party, misuse of the cake, failure to adhere to any provided instructions, or alterations conducted by a third party.

 

Please be advised that I cannot replicate the work of other cake makers due to ethical standards; however, I am open to using photographs as sources of inspiration. If you would like to utilise photographs from another cake maker, please specify the particular details during our discussion.

 

We cannot guarantee that the colour of fondant, buttercream, or similar materials will exactly match those depicted in the provided images. Various factors, including lighting, computer screen calibration, and photography, may affect the final appearance of our uploaded images.

 

The final price may be subject to change if modifications are made to the original request (e.g., size, flavor, or design). Any adjustments will be mutually agreed upon before we commence with the order.

 

**Cancellation**

Refund policy:

If an order was made as requested yet there is simply a difference in preference of taste or texture then a refund will not be given. No refunds will be given for a difference in design tastes unless an order is very different to what was requested – to be determined by Livvy's Kitchen Cupcakes . Specific design requests should always be stated at the time of ordering and no changes to this can be guaranteed once the initial payment has been received. No refunds are given in the event of a lack of communication about any elements – such as if the customer wanted fully edible flowers but didn’t state this preference. 
There are no refunds/exchanges or returns on edible food products. In the event that you are dissatisfied, the cake should be returned within 24 hours of your event for an investigation to be carried out. Without the product being returned there are no concessions that can be made. Refunds will not be given without the return of the original product.

 

In the event of cancellation, a deduction may be made for any work already initiated or materials purchased that cannot be repurposed for another cake.

 

Payments will not be refunded for orders cancelled with less than five days' notice.

 

All cancellations must be communicated via email at hello@livvyskitchencupcakes.com.

 

In the unlikely circumstance that I must cancel your order, any payments made will be fully refunded.

 

Livvy’s Kitchen Cupcakes reserves the right to cancel, modify, or suspend the operation of this contract in response to events beyond our control, such as fire, floods, storms, equipment failure, strikes, civil disturbances, supply shortages, illness, or any other unforeseen circumstances. We shall not be held liable for any breach of contract arising from such events.

 

**Collection and Delivery**

 

A delivery charge of £8 will apply within a 5-mile radius. Deliveries beyond this radius will incur an additional fee of £10 plus 45 pence per mile for the return trip.

 

Cakes priced over £250 will qualify for complimentary delivery.

 

Please note that delivery fees may increase due to inflation, fuel prices, taxation, or insurance costs.

 

The collection address will be provided upon receipt of your booking fee.

 

To transport your cake safely, please ensure that the boot of your vehicle is clear before collection.

 

**Allergies**

 

Livvy's Kitchen Cupcakes prepares all cakes in an environment where nuts, milk, and dairy products are handled. We are unable to guarantee an allergen-free environment. We will make every effort to utilise separate utensils, bowls, mixers, and pans for individuals with nut allergies, and prioritise your cake as the first bake of the day. However, the presence of nut particles in the atmosphere cannot be eliminated.

 

**Transportation**

 

Cakes should always be transported in the boot or passenger footwell of your vehicle, not on a seat or a passenger's lap. If necessary, I can provide a piece of non-slip material to assist with safe transportation.

Contract

Livvy's Kitchen Cupcakes will not disclose your details to any third parties and is a spam-free zone. All information that is kept on each customer of Livvy's Kitchen Cupcakes, including yourself, includes your name, email address, and telephone number, if provided. Your data will be kept securely and used only by Livvy's Kitchen Cupcakes to communicate with you regarding your order (s) and any products or services offered by giving your email address. You can request that your information be deleted by contacting Livvy's Kitchen Cupcakes by email.
